Terms governing use of the FCOS (Food Compliance OS) service.

The agreement

These Terms of Service (“Terms”) govern access to and use of FCOS (Food Compliance OS) (“FCOS”, “we”, “us”) and our websites, applications, and related services (collectively, the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent (“Customer”).

Legal entity placeholder. The contracting party may be identified as “FCOS” / Food Compliance OS for public-facing materials until your registered legal entity name and jurisdiction are finalized. Replace this section with counsel-approved wording.

The service

FCOS provides B2B tools to manage nutrition-related product information, labeling workflows, and related outputs. Features may change over time. We may suspend or discontinue parts of the Service with reasonable notice where practicable.

The Service is not a substitute for legal, regulatory, or professional advice about food labeling, health claims, or market-specific requirements. You remain responsible for compliance with applicable laws and for the accuracy of data you enter.

Accounts

You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. Notify us promptly of unauthorized use.

Customer data

You retain rights to information and content you submit to the Service (“Customer Data”). You grant FCOS a limited license to host, process, and display Customer Data solely to provide and improve the Service, secure our systems, and comply with law. See our Privacy Policy for how personal data is handled.

Acceptable use

You agree not to:

  • misuse the Service or attempt to access non-public areas without authorization;
  • upload malware, probe or scan systems without permission, or interfere with other users;
  • use the Service in violation of law or third-party rights;
  • reverse engineer the Service except where permitted by applicable law.

Disclaimers; limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FCOS DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FCOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, EXCEPT WHERE PROHIBITED BY LAW. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (OR LOCAL EQUIVALENT), UNLESS A DIFFERENT CAP IS REQUIRED BY LAW.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.
